DOJ Puts Fortune 500 On Notice: Replacing Americans With Cheap Foreign Visa Workers Is A Federal Crime

America’s corporate class has spent decades running a quiet racket — gaming the H-1B visa system to swap out qualified American workers for cheaper foreign labor, pocketing the difference, and daring anyone to call it discrimination. That game may finally be over.

The Justice Department’s Civil Rights Division, led by Assistant Attorney General Harmeet Dhillon, has chosen to prioritize the defense of American workers from discrimination in the workplace. “We have absolutely ramped this up big time, and it’s our main focus,” Dhillon told streamer Sara Gonzales on September 2. “Almost all of our new cases involving labor discrimination actually involve discrimination against Americans.”

It is not a fringe issue. Over 1.5 million foreign visa workers are employed in jobs that would otherwise go to U.S. citizens and their families. At least 730,000 foreign nationals are employed in the U.S. through the H-1B program, with an additional 150,000 spouses. While corporations claim there is a shortage of skilled workers, unemployment and underemployment among American computer science graduates sits at 26 percent, according to Federal Reserve Bank of New York data.

Dhillon explained how Fortune 500 companies use so-called “body shops” — foreign import contract systems spanning numerous tiers — to exploit workers. By the time a worker is paid, wages have already been processed through multiple intermediaries, each skimming a cut. Workers cannot complain. Losing visa status is the outcome for those who speak out.

“It is a form of human trafficking,” Dhillon said plainly.

The Inspector General of the Department of Labor was even more direct. “This is not just fraud: This is a criminal enterprise that stretches far beyond the borders of America,” IG Anthony D’Esposito told Breitbart News in July. He confirmed investigators are building cases linking body shop kickback schemes to transnational organized crime and gangs.

Dhillon pointed out the dirty secret that corporate America on both sides of the political aisle shares: “Employers who are conservative, employers who are liberal, they’re all benefiting from paying a lower wage to foreigners, and they’re trying to protect their bottom line.”

A UnitedHealth Group subsidiary — Optum, which helps manage veteran healthcare — was already caught in a federal conviction where a job was sold for kickback money to a foreign worker. Fortune 20 companies are currently in active federal conciliation proceedings, according to Dhillon.

The DOJ is now enforcing an interpretation of existing civil rights law that prior administrations deliberately ignored: being American is a national origin, and systematically discriminating against Americans in hiring is a violation of federal law.

The establishment press is furious. The New York Times quoted Biden-era DOJ veteran Vanita Gupta claiming Dhillon has “corrupted” the Civil Rights Division. Translation: the division is now actually protecting American workers instead of globalist carve-outs.

Vice President JD Vance is pushing a $103,265 fee on every new H-1B visa. Regulations are being written. Prosecutions are coming. The swamp always assumed there would be no accountability. They were wrong.
