Federal court tosses Dem Rep’s appeal to clear charges for assaulting ICE agent

New Jersey Democratic Rep. LaMonica McIver lost her appeal after a federal grand jury charged her with interfering with law enforcement operations.

McIver was seen on video assaulting an ICE officer as a mob was attempting to storm an ICE facility on May 9th, 2025.

In June, a federal grand jury delivered a three-count indictment against McIver for allegedly forcibly assaulting, impeding, intimidating, and interfering with ICE and Homeland Security Investigators. The Democrat Rep. tried to appeal the charges by claiming legislative immunity, but on Wednesday a federal court tossed that too.

Law professor Jonathon Turley wasn’t surprised:

McIver faces 8 years in prison plus fines for each of Counts 1 & 2 and up to 1 year for Count 3, simple assault. That’s a combined statutory maximum of 17 years, not including fines.
