The Supreme Court has rejected the Department of Justice\u2019s emergency appeal regarding the California midterms.<\/p>\n

The DOJ believes that there are a large number of noncitizens on the voter rolls in California, though the state denies that claim. On Monday, U.S. District Court for the District of Columbia by Chief U.S. District Judge James Boasberg shot down the government\u2019s case saying that the \u201cflawed lists\u201d have a \u201chigh error rate\u201d and that taking the desired action would \u201crisk chilling or preventing lawful votes from being cast and counted.\u201d<\/p>\n

\u201cThe Executive Branch has likely violated the Constitution\u2019s Elections Clause, which commits authority over election rules to the states and Congress alone,\u201d he added. \u201cCalifornia may decide for itself what procedures to use for verifying the citizenship of registered voters and for deciding whether to count their mail-in ballots.\u201d<\/p>\n

This didn\u2019t sit well with the DOJ, which quickly appealed the decision to the Supreme Court. They asked to have ballots mailed to more than 20,000 voters set aside, but SCOTUS was unusually quick<\/a> to respond.<\/p>\n

\u201cThe<\/span> application<\/span> for injunction<\/span> pending<\/span> appeal presented<\/span> to <\/span>Justice Kagan<\/span> and<\/span> by<\/span> her<\/span> referred<\/span> to the<\/span> Court is denied,\u201d the order read, not giving any reason or context to the rejection.<\/span><\/p>\n
