The U.S. Department of Justice (DOJ) has filed a lawsuit against the state of California after determining that its voter list reveals more than 20,000 likely aliens are registered to vote in the state.<\/p>\n

\u201cState-facilitated voter fraud is unacceptable in the United States of America,\u201d Attorney General Todd Blanche\u00a0said<\/a>\u00a0Thursday in a statement. \u201cIf found responsible in a court of law, the State of California will have seriously undermined confidence in our electoral system and violated laws that protect our nation\u2019s representative system of government. The Department of Justice will continue working to uncover cases of voter fraud, hold fraudsters accountable, and restore trust in American elections.\u201d<\/p>\n

In its\u00a0complaint<\/a>, the DOJ observes that, for each election in California, \u201cthe State automatically sends all registered voters vote-by-mail ballots.\u201d<\/p>\n

\u201cThose ballots do not bifurcate between state, local, and federal elections. Nor do they warn aliens that they are prohibited to vote in federal elections,\u201d the department asserts. \u201cWhile California reviews signatures before tabulating cast ballots, there is a strong presumption of validity even for ballots signed not with a name but with a simple \u2018X.\u2019\u201d<\/p>\n

Having worked jointly with the U.S. Department of Homeland Security (DHS) \u2013 under Secretary Markwayne Mullin \u2013 the DOJ continues in the complaint that a \u201cthorough analysis of voter rolls and federal data\u201d revealed \u201cthousands of likely noncitizens registered to vote in California who would automatically be sent federal ballots under State law.\u201d<\/p>\n

The department argues further:<\/p>\n

Thus, months before California started sending vote-by-mail ballots to all registered voters, the Federal Government alerted the California Secretary of State that a preliminary review of California\u2019s voter roll revealed that numerous likely noncitizens were registered to vote in California \u2026 The Federal Government asked California to work collaboratively to identify any noncitizens registered to vote in the State. California made no serious effort to do so \u2026 and as required by State law, began sending vote-by-mail ballots to all registered voters in early October\u2014including, it seems, to those who the Federal Government considered as likely noncitizens.<\/p>\n<\/blockquote>\n

In response to the DOJ\u2019s complaint, California Secretary of State Shirley N. Weber\u00a0wrote<\/a>\u00a0that the letter sent to her by the department contained \u201cSecretary Mullin\u2019s vague allegation that non-citizens may be registered to vote in California.\u201d<\/p>\n

Weber added the DOJ was engaged in \u201cunsubstantiated claims and outrageous demands.\u201d<\/p>\n

\u201c[Y]ou demand that we request transmittal of the list, review and confirm the citizenship status of each of the approximately 20,000 individuals on the list on the eve of an election and within a mere 48 hours,\u201d she protested. \u201cThis is an emergency of the DOJ\u2019s creation.\u201d<\/p>\n

But First Assistant U.S. Attorney Bill Essayli for the Central District of California asserted in a statement that \u201cCalifornia election officials were given an opportunity to remove noncitizens from their voter rolls and to sequester ballots returned from suspected ineligible voters. They refused.\u201d<\/p>\n

\u201cWe are taking California to federal court to demand that the votes of American citizens not be diluted by noncitizens,\u201d Essayli added.<\/p>\n

Mullin underscored that DHS and its federal partners \u201creviewed publicly available California voter-registration files and compared relevant records with federal immigration data to identify alien registrants.\u201d<\/p>\n

\u201cThis preliminary analysis has identified a significant number of individuals in California who are likely noncitizens and appear to be registered to vote; the analysis and review remain ongoing,\u201d he said. \u201cThis is completely unacceptable \u2014 as even one noncitizen vote cancels out the ballot of an American citizen and undermines our elections.\u201d<\/p>\n

\u201cDHS is committed to identifying unlawful voting, protecting the integrity of federal elections, and ensuring that only eligible American citizens elect America\u2019s leaders,\u201d Mullin added.<\/p>\n
