In a huge win for the Trump administration on Friday, the Supreme Court voted 6-3 to reinstate a federal program that helps states verify whether registered voters are U.S. citizens in time for the November midterm elections.<\/p>\n

Save was reactivated by the High Court as the program had been greatly expanded from its original purpose by then President Trump in his March 2025 executive order on Election Integrity, to include, among other things, the ability to search the database of records of births to U.S. citizens as well as of issued Social Security numbers to verify the citizenship of those on the voter rolls of the states.<\/p>\n

The updated SAVE program was put into place by the Trump administration in March 2025 when the President issued an executive order directing Homeland Security and the Social Security Administration to develop systems to allow state and local election officials to verify whether individuals on voter rolls were US citizens and of lawful immigration status. The system that was set up vastly expanded upon the original SAVE system that was designed to verify the identity and citizenship status of individuals applying for government benefits. The system now includes records of all US-born citizens, allows individuals to verify access to their Social Security number, and most importantly to the voter ID verification effort allows for bulk searches of records rather than individual one-at-a-time verification checks.<\/p>\n

Instead, a coalition of left-wing organizations led by the League of Women Voters have attacked SAVE as an unconstitutional program that violates the Social Security Act, the Privacy Act and the Administrative Procedures Act. D.C. District Judge Sparkle Sooknanan, a Biden appointee, ultimately agreed with the plaintiff organizations and issued an injunction against the program’s use. The D.C. Circuit Court of Appeals upheld Judge Sooknanan’s lower court decision in a 2-1 ruling in September.<\/p>\n

Instead, the Supreme Court ruled in a per curiam opinion that the plaintiffs were unlikely to succeed on the merits of their case because Congress had specifically authorized DHS to request “information concerning the citizenship and immigration status of individuals” from other agencies in the Illegal Immigration Reform and Immigrant Responsibility Act of 1996. As a result, the Court ruled that the stay factors weighed in the administration’s favor.<\/p>\n

Justices Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson dissented from the Court’s ruling. In a particularly revealing line of her dissent, Justice Jackson acknowledged that the Supreme Court’s ruling would have “minimal short-term impact” but added that states would certainly use the SAVE system to verify the citizenship status of their voters for the November midterm elections.<\/p>\n

There are two differing perspectives being proffered by the left and election integrity advocates. The first is that the program poses the risk of removing legitimate voters from the rolls. The second is that Democrats are utilizing voter rolls as a means to purge the rolls of those that should never have been placed on the lists in the first place.<\/p>\n

Notably, ballots for the elections in many states are already being printed. However, the stay is still in effect while the Trump administration is pursuing an appeal to the D.C. Circuit, with the possibility of the case being brought to SCOTUS on the merits of the lower court’s decision.<\/p>\n
