In a move that the administration had long been saying was coming, Huawei Technologies, a giant Chinese telecommunications equipment manufacturer with deep ties to the People’s Liberation Army, is finally sitting in the defendant’s chair in a Brooklyn federal courtroom. And what the U.S. Department of Justice calls in three short words “theft, lies, cover-up” \u2014 a 20-year indictment of a business model \u2014 is quite damning.<\/p>\n

Assistant U.S. Attorney Taylor Stout laid out the basic pattern of Huawei’s behavior in opening his case against the Chinese tech giant on September 9. Stout told a jury of eight that when Huawei’s U.S. subsidiaries, including Huawei Device USA and Futurewei Technologies, were not acting as sales and service arms of a legitimate high tech company, they were instead “engaging in a pattern of criminal activity” in order to aid Huawei’s growth into a global technology behemoth. And a large portion of that criminal activity involved stealing trade secrets from other companies to aid Huawei in developing its own competing products. One such Huawei employee even received a bonus for having stolen the cellular antenna technology developed by a New York-based Quintel engineer.<\/p>\n

Prosecutors say the theft extends to a wide range of technologies including router source code for Cisco Systems’ mobile routers, technology for wireless storage systems, and other forms of wireless technology for T-Mobile. One engineer was caught by taking photos of the inside of a T-Mobile robotic device used to test phones and then walking out of the building with a key component to the device in his backpack. This is what Beijing’s technology strategy looks like at the street level.<\/p>\n

Perhaps most damning, however, is the detail provided regarding Huawei’s business in Iran. As part of the indictment, the government has alleged that through a Huawei subsidiary called Skycom, Huawei provided Iranian surveillance tools that were used to monitor the citizens of that country during the 2009 Tehran protests. Employees of the company falsely represented to banks such as HSBC and Citi that Skycom was a separate entity from Huawei. Component parts that were shipped to Iran had all Huawei logos removed at the direction of Huawei management. The government alleges further that Huawei committed sanctions violations in connection with the activities of Huawei in North Korea.<\/p>\n

While the case against Huawei Technologies is working its way through the federal courts, the real cost to the American economy of Chinese IP theft is a massive number that The Federalist’s Helen Raleigh estimates to be between $225 billion and $600 billion per year. Huawei Technologies was once a small start-up company in China, but today it is the world’s largest supplier of telecom equipment, in large measure because of its willingness to steal IP from American companies and then sell it back to them at below cost. The cautionary tale of Nortel, once Canada’s dominant supplier of telecom equipment, is of a company whose years of networks being intruded into by Beijing-based parties coincided with the rise of Huawei to challenge Nortel for market share \u2014 and then to drive it to bankruptcy.<\/p>\n

In a related action, six Chinese artificial intelligence (AI) firms including DeepSeek and Moonshot have been accused by the U.S. government of “industrial-scale distillation” of AI developed by American companies including OpenAI, Anthropic and Google. Different method, same modus operandi.<\/p>\n

The trial also comes at an important time, as President Trump is set to meet with Chinese President Xi Jinping later this month. The President has the perfect tool to negotiate with the Chinese President: a full exposure of Beijing’s state-backed theft of American technology. The Brooklyn courtroom is just seeing the tip of a very large iceberg.<\/p>\n
