One of the myriad redistricting efforts that could stave off a passing of the gavel may have left court watchers with whiplash Tuesday when Supreme Court Justice Brett Kavanaugh\u2019s emergency appeal denial was countered with a temporary restraining order allowing the GOP\u2019s edge to proceed \u2014 for now.<\/p>\n<p>After last week\u2019s Missouri Supreme Court decision\u00a0<a href=\"https:\/\/www.bizpacreview.com\/2026\/09\/04\/missouri-supreme-court-blocks-new-gop-friendly-house-map-after-primary-for-midterms-1657612\/\" target=\"_blank\" rel=\"noopener\">blocked<\/a><a href=\"https:\/\/www.bizpacreview.com\/2026\/09\/04\/missouri-supreme-court-blocks-new-gop-friendly-house-map-after-primary-for-midterms-1657612\/\">\u00a0the revised congressional map<\/a>, which shifted the balance from six Republican and two Democratic districts to seven and one, Missouri Attorney General Catherine Hanaway (R) filed an emergency application with the U.S. Supreme Court.<\/p>\n<p>Tuesday, Kavanaugh denied the application, thus maintaining the ruling of the Missouri Supreme Court, only for a 14-day temporary restraining order to be issued by Chief U.S. District Judge Stephen Clark for the Eastern District of Missouri shortly thereafter.<\/p>\n<p>Clark\u2019s <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.moed.231153\/gov.uscourts.moed.231153.35.0.pdf\">TRO<\/a> enjoined Missouri Secretary of State Denny Hoskins (R) and other officials \u201cfrom implementing, using, publishing, distributing, or mandating the use of any congressional map other than the HB 1 map for the November 3, 2026 general election.\u201d He argued that to use any congressional map differing from the revised map used in the August 4, 2026 primary elections would mean, \u201cVoters reassigned to [a] different district would have cast their votes in vain for candidates now connected to other districts, effectively nullifying their votes.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\"><img decoding=\"async\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/17.0.2\/72x72\/1f6a8.png\" alt=\"\ud83d\udea8\" class=\"wp-smiley\" \/> A federal judge has restored Missouri\u2019s 2025 congressional map for the November election, just minutes after Justice Kavanaugh separately denied the state\u2019s bid to revive it. <a href=\"https:\/\/t.co\/77r3RQPep6\">pic.twitter.com\/77r3RQPep6<\/a><\/p>\n<p>\u2014 SCOTUS Wire (@scotus_wire) <a href=\"https:\/\/x.com\/scotus_wire\/status\/2097445750913245264?ref_src=twsrc%5Etfw\">September 8, 2026<\/a><\/p>\n<\/blockquote>\n<p>In her emergency application for stay to the U.S. Supreme Court, Hanaway argued the state \u201craised several federal constitutional defenses to avoid this catastrophic scenario,\u201d wherein \u201chundreds of thousands of voters\u201d would be disenfranchised, \u201cbut the Missouri Supreme Court simply ignored them.\u201d<\/p>\n<p>Reacting to Clark\u2019s order, she wrote on X, \u201cMissouri is prepared to follow and comply with Chief Judge Clark\u2019s order that binds the state to using the Missouri FIRST map for the November General Election.\u201d<\/p>\n<p>\u201cWe maintain that changing the congressional map in between the primary and general elections is simply not feasible and profoundly unjust to Missouri voters,\u201d added the secretary.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Missouri is prepared to follow and comply with Chief Judge Clark\u2019s order that binds the state to using the Missouri FIRST map for the November General Election. Chief Justice W.
