{"id":658968,"date":"2026-08-28T00:30:00","date_gmt":"2026-08-28T00:30:00","guid":{"rendered":"https:\/\/buglecall.org\/?p=658968"},"modified":"2026-08-28T00:30:00","modified_gmt":"2026-08-28T00:30:00","slug":"federal-court-dismisses-musks-x-lawsuit-against-new-york-law-forcing-platforms-to-define-speech-2","status":"publish","type":"post","link":"https:\/\/buglecall.org\/?p=658968","title":{"rendered":"Federal Court Dismisses Musk&#8217;s X Lawsuit Against New York Law Forcing Platforms To Define Speech"},"content":{"rendered":"<p><span class=\"field field--name-title field--type-string field--label-hidden\">Federal Court Dismisses Musk&#8217;s X Lawsuit Against New York Law Forcing Platforms To Define Speech<\/span><\/p>\n<div class=\"clearfix text-formatted field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p>A Trump-appointed judge just dismissed a lawsuit by Elon Musk\u2019s X seeking to void a <strong>New York state law requiring social media companies to disclose how they define and monitor hate speech<\/strong>, extremism, harassment, foreign political interference and disinformation.<\/p>\n<p><a data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/former-twitter-manager-elon-musk.jpg?itok=uaGVdV8z\" data-link-option=\"0\" href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/former-twitter-manager-elon-musk.jpg?itok=uaGVdV8z\"><img fetchpriority=\"high\" decoding=\"async\" data-entity-type=\"file\" data-entity-uuid=\"ae0d5c19-8c0d-4403-9c1f-87952529ec90\" data-responsive-image-style=\"inline_images\" height=\"263\" width=\"500\" class=\"inline-images image-style-inline-images\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/former-twitter-manager-elon-musk.jpg?itok=uaGVdV8z\" alt=\"\" \/><\/a><\/p>\n<p>U.S. District Judge John Cronan in Manhattan<strong> rejected X\u2019s argument that the Stop Hiding Hate Act violated the U.S. Constitution&#8217;s First Amendment<\/strong> by exposing it to lawsuits and big fines unless it disclosed &#8220;highly sensitive and controversial speech&#8221; that the state found objectionable.<\/p>\n<p>Additionally, Cronan\u00a0<strong>dismissed the case with prejudice, prohibiting X from refiling an updated claim on the same issue.<\/strong><\/p>\n<p><strong>New York Attorney General Letitia James<\/strong> formally filed for the case to be dismissed in November 2025, saying the law helped consumers understand what to expect from social media, without blocking platforms from \u200cspeaking out or exercising their own judgment when moderating content.<\/p>\n<p>Most notably,\u00a0<strong>X Corp. pointed to a separate lawsuit it brought against California\u2019s Assembly Bill 587, which it argued was \u201cidentical in all material respects\u201d<\/strong> to S895B.<\/p>\n<p>The Ninth U.S. Circuit Court of Appeals, which oversees California, held that AB 587\u2019s content-category reporting provisions compelled non-commercial speech about contested political topics, which triggered strict scrutiny of the law under the First Amendment.<\/p>\n<p>However, Cronan wrote that\u00a0<em><strong>\u201c[t]he First Amendment poses no obstacle to New York\u2019s law.&#8221;<\/strong><\/em><\/p>\n<p>He added:<\/p>\n<p><em>\u201c<strong>Businesses might not always want to share every detail about the products or services they offer<\/strong>. But when the government requires those businesses to speak truthfully about their offerings, the First Amendment typically allows for that kind of disclosure requirement.\u201d<\/em><\/p>\n<p>Musk\u2019s company also said it already dedicates resources to regulating \u201chateful conduct\u201d and that this would not be recognized under New York\u2019s categories of \u201chate speech,\u201d \u201cracism,\u201d or \u201cextremism.\u201d It also listed its efforts to regulate what it calls \u201cmanipulated, or out-of-context media that may result in widespread confusion on public issues, impact public safety, or cause serious harm,\u201d but that would not be recognized by the New York law.<\/p>\n<p>Nevertheless, the law was struck down on First Amendment grounds.<\/p>\n<p>In this case, Cronan dismissed the California case (X Corp vs Bonta) stating that the level of scrutiny applicable was \u201cZauderer scrutiny,\u201d which is \u201cmore relaxed than ordinary intermediate or strict scrutiny.\u201d<\/p>\n<p><a data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/image%20-%202026-08-27T143246.153.jpg?itok=Vx3GUw-p\" data-link-option=\"0\" href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/image%20-%202026-08-27T143246.153.jpg?itok=Vx3GUw-p\"><img decoding=\"async\" data-entity-type=\"file\" data-entity-uuid=\"dfaa2b9b-d172-4523-8c5d-af5cea1daf65\" data-responsive-image-style=\"inline_images\" height=\"333\" width=\"500\" class=\"inline-images image-style-inline-images\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/image%20-%202026-08-27T143246.153.jpg?itok=Vx3GUw-p\" alt=\"\" \/><\/a><\/p>\n<p>Under the<a href=\"https:\/\/en.wikipedia.org\/wiki\/Zauderer_v._Office_of_Disciplinary_Counsel_of_Supreme_Court_of_Ohio\"> &#8216;Zauderer standard&#8217;<\/a>, the<strong> government can usually force a business to state purely factual, uncontroversial information about what it sells,<\/strong> so long as the requirement is reasonably related to preventing consumer confusion and is not unduly burdensome.<\/p>\n<p><em>Calorie counts, ingredient lists, and \u201cyou may still owe costs if you lose\u201d in a lawyer ad are the classic examples<\/em>.<\/p>\n<p><strong>Cronan put the Stop Hiding Hate reports in that box<\/strong>, analogized them to menu-labeling, and applied the relaxed standard.<\/p>\n<p>He also held Section 230 does not preempt a reporting duty that attaches to incomplete or false filings rather than to the moderation decisions themselves.<\/p>\n<p><strong>The problem is the categories.<\/strong><\/p>\n<p>The law does not just say \u201cpublish your existing terms of service.\u201d<\/p>\n<p><strong>It requires platforms to state whether and how they define \u201chate speech or racism,\u201d \u201cextremism or radicalization,\u201d \u201cdisinformation or misinformation,\u201d \u201charassment,\u201d and \u201cforeign political interference,\u201d then report enforcement data sliced by those buckets. <\/strong><\/p>\n<p>However, those labels are not commercial product specs, they are contested political and legal concepts.<\/p>\n<p>Platforms that refuse the state\u2019s taxonomy, use different terms (\u201chateful conduct,\u201d \u201cviolent speech,\u201d \u201csynthetic media\u201d), or treat some of those categories as viewpoint-laden rather than objective, are being forced to translate their editorial judgments into the state\u2019s vocabulary <strong>under threat of $15,000-a-day fines<\/strong>.<\/p>\n<p>That is closer to compelled speech about contested public issues than to \u201cthis yogurt has 140 calories.\u201d<\/p>\n<p>A Trump-appointed SDNY judge reaching the opposite result from a Ninth Circuit panel <strong>is not a partisan surprise; it is a circuit split on a hard First Amendment question.<\/strong><\/p>\n<p>However<strong>, choosing to rule with prejudice\u201d and no leave to amend is aggressive<\/strong>.<\/p>\n<p>X\u2019s theory is not frivolous;
