Gavin Newsom and others that the Framers would have supported wealth taxes, including the proposed Billionaire\u2019s Tax. <strong>It is a claim that seeks to mask the\u00a0<a href=\"https:\/\/jonathanturley.org\/2026\/02\/13\/eat-the-rick-california-democrats-trigger-a-reverse-gold-rush-with-a-wealth-tax\/\">economically unwise<\/a>\u00a0with the historically unfounded. The Framers sought to protect property from legislative redistributive impulses. <\/strong>James Madison wrote that the bicameral system, and particularly the Senate, \u201cought to be so constituted as to protect the minority of the opulent against the majority.\u201d That does not sound like an ally of Bernie Sanders and Ro Khanna.<\/em><\/p>\n<p>Was James Madison the Zohran Mamdani of his time? Gavin Newsom appears to think so. In joining the growing number of Democratic leaders supporting a wealth tax, the California governor claimed that the U.S. Constitution and our Founders were all about wealth distribution: <em><strong>\u201cThe system America\u2019s founders built,\u201d\u00a0<a href=\"https:\/\/www.cnn.com\/2026\/06\/26\/politics\/gavin-newsom-billionaire-tax-california\">he said<\/a>, \u201cwas designed to prevent the concentration of power in a few hands, but we have allowed that concentration to happen anyway, slowly, in plain sight, over decades.\u201d<\/strong><\/em><\/p>\n<p><a data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/image%20-%202026-07-05T115042.627.jpg?itok=iNgv6hq7\" data-link-option=\"0\" href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/image%20-%202026-07-05T115042.627.jpg?itok=iNgv6hq7\"><img fetchpriority=\"high\" decoding=\"async\" data-entity-type=\"file\" data-entity-uuid=\"5287c1dd-05fa-49e2-8b36-3c0770ed13ea\" data-responsive-image-style=\"inline_images\" height=\"333\" width=\"500\" class=\"inline-images image-style-inline-images\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/image%20-%202026-07-05T115042.627.jpg?itok=iNgv6hq7\" alt=\"\" \/><\/a><\/p>\n<p><strong>The only problem with this argument is that it is utterly and demonstrably false.<\/strong> The Madisonian democracy is designed to avoid the concentration of\u00a0<em>political\u00a0<\/em>power, not the concentration of wealth.<\/p>\n<p>The Founders were great believers in capitalism and the free market. In my recent book, \u201c<a href=\"https:\/\/www.amazon.com\/Rage-Republic-Unfinished-American-Revolution\/dp\/1668205025\/ref=tmm_hrd_swatch_0?_encoding=UTF8&amp;dib_tag=se&amp;dib=eyJ2IjoiMSJ9.RRwQP-jxib6FGPIATmKf_-qZ54EqdtHH96MILgFFNEu2d_chUIjFQbBNWZj6-YWIsRTxEeuGYCTw-gDvcdUE1puVoYeX2uBJyqcXA64EqxaA3kXW04dbyRE6t7mOEnrcSOf8BIA7KP47sQttP-6j4qWXwt_gUgP9AJ6jJ1HWnqU62QYxnVkcOQhwCaeyp8o8.-FQ90bYCtRhnfQk9vLhvb1kV2q0kmzaKPZqwWwUateA&amp;qid=1749518291&amp;sr=1-5\">Rage and the Republic,<\/a>\u201d I discuss the economic philosophy of the Founders in exploring the history and future of this unique republic. This isn\u2019t simply the 250th anniversary of the Declaration of Independence but also the anniversary of the publication of Adam Smith\u2019s \u201cThe Wealth of Nations,\u201d which the Founders embraced.<\/p>\n<p><strong>Many of the Founders were themselves quite wealthy, including banker\u00a0Robert\u00a0Morris\u00a0Jr., who was known as the \u201cFinancier of the Revolution\u201d and would be a billionaire today.<\/strong><\/p>\n<p>Our revolution was the first true Enlightenment revolution, heavily influenced by writers such as John Locke, who believed in a natural right to property. That right came not from the government, but from God, and \u201cexcludes the common right of other Men.\u201d<\/p>\n<p>That Lockean principle was manifest in George Mason\u2019s Virginia Declaration of Rights, which was a basis for the Declaration of Independence. It\u00a0<a href=\"https:\/\/www.archives.gov\/founding-docs\/virginia-declaration-of-rights\">extolled<\/a>\u00a0\u201cthe enjoyment of life and liberty, with the means of acquiring and possessing property, and pursuing and obtaining happiness and safety.\u201d<\/p>\n<p><strong>James Madison\u00a0drafted\u00a0protections from government seizure of property, including the Takings Clause of the\u00a0Fifth\u00a0Amendment, which requires compensation for any property taken by the government.<\/strong><\/p>\n<p>The Constitution not only protects property, but was later amended to allow for income taxes rather than wealth taxes.<\/p>\n<p><strong>Far from supporting a wealth tax, the constitutional system referenced by Mr. Newsom makes a federal wealth tax unconstitutional.<\/strong><\/p>\n<p>Mr. Newsom\u2019s recent endorsement of a national wealth tax was likely meant to blunt the outrage over his opposition to the resolution to create a state Billionaires\u2019 Tax on the coming November ballot.<\/p>\n<p>California has reportedly lost trillions of dollars in the exodus of billionaires and other wealthy taxpayers fleeing the high taxes and class politics of the state. Mr. Newsom knows that this draining of wealth spells doom for his state, which is already grappling with a massive, growing deficit. He\u00a0<a href=\"https:\/\/www.pbs.org\/newshour\/politics\/newsom-urges-a-national-billionaires-tax-while-fighting-one-in-california\">offered<\/a>\u00a0a curious argument for opposing the state wealth tax: \u201cYou may not be able to pick up and move to Texas or Florida to shelter your income from taxation, but I promise you that billionaires can, and do.\u201d<\/p>\n<p><strong>The argument suggested that most citizens are effectively a captive population to be culled by California leaders, dupes who are unable to escape a state with a deadly combination of some of the highest taxes and highest living costs in the nation.<\/strong><\/p>\n<p>Unions and others pushed the Billionaire Tax to avoid budget cuts and fund the state\u2019s runaway expenditures, from pension funds to projects such as the infamous\u00a0<a href=\"https:\/\/www.wsj.com\/opinion\/bidens-3-1-billion-train-ticket-to-nowhere-california-high-speed-rail-project-6e7045a1\">high-speed train<\/a>\u00a0to nowhere.<\/p>\n<p>To deal with California\u2019s reverse Gold Rush,\u00a0drafters\u00a0made the proposed Billionaire Tax retroactive to claw back money from those who have escaped.<\/p>\n<p>The national Billionaire Tax pushed by Sens. Bernie Sanders (I., Vt.) and Elizabeth Warren (D., Mass.) seeks to cut off any escape for the wealthy short of leaving the country. When she ran for president, Ms. Warren\u00a0<a href=\"https:\/\/thehill.com\/opinion\/finance\/456037-democrats-demonize-wealthy-to-deflect-from-disastrous-agendas\/\">warned<\/a>\u00a0the wealthy that she was coming for \u201cyour Rembrandts, your stock portfolio, your diamonds and your yachts.\u201d<\/p>\n<p>Of course, this assumes that the wealthy would be little more than passive prey in a hunt by the Internal Revenue Service. That is precisely what socialists thought in France decades ago, before an exodus from the country that, along with other socialist policies, brought it to near economic ruin. It was later rescinded.<\/p>\n<p><strong>Nevertheless, wealth taxes make for great politics. <\/strong>What is concerning is that, in addition to a wealth tax, Democratic leaders like Ms. Warren are pledging to pack the Supreme Court if they retake power.
