On Tuesday, that manifested in the DOJ\u2019s Office of Legal Counsel taking measures to restore \u201cour colorblind Constitution\u201d by working with the Equal Employment Opportunity Commission (EEOC) to consider disparate-impact liability guidelines as unconstitutional.<\/p>\n<p>In a <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-concludes-eeoc-disparate-impact-guidelines-violate-constitution\">joint release<\/a> from the agencies, the DOJ detailed,\u00a0\u201cThe Office of Legal Counsel found that EEOC\u2019s guidelines pressured employers to engage in racial discrimination. Under those guidelines, employers could be held liable for unequal hiring and promotion outcomes among different groups, without regard to the employer\u2019s likely intent.\u201d<\/p>\n<p>\u201cDespite trying to promote equality, EEOC\u2019s disparate impact liability interpretation under Title VII actually fosters the very discrimination its guidelines seek to address,\u201d stated Acting Attorney General Todd Blanche. \u201cThis opinion will now allow businesses to hire based on performance, restoring equal opportunities to the American workplace.\u201d<\/p>\n<p>Likewise, EEOC Chair Andrea Lucas expressed, \u201cThe EEOC is grateful for the thoughtful and insightful analysis provided by Assistant Attorney General Gaiser and Deputy Assistant Attorney General Craddock regarding disparate impact under Title VII.\u201d<\/p>\n<p>\u201cWe believe this opinion will provide clarity regarding the Constitutional limits of disparate impact in employment discrimination matters,\u201d she went on before addressing her gratitude for the partnership with the DOJ to restore \u201cour colorblind Constitution.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">I am grateful for <a href=\"https:\/\/x.com\/TheJusticeDept?ref_src=twsrc%5Etfw\">@TheJusticeDept<\/a>\u2018s partnership with EEOC in restoring \u201cour colorblind Constitution.\u201d<\/p>\n<p>\u2014 EEOC Chair Andrea Lucas (@andrealucasEEOC) <a href=\"https:\/\/x.com\/andrealucasEEOC\/status\/2064428967881249075?ref_src=twsrc%5Etfw\">June 9, 2026<\/a><\/p>\n<\/blockquote>\n<p>The release itself\u00a0referred to President Donald Trump\u2019s April 2025 <a href=\"https:\/\/www.bizpacreview.com\/2025\/04\/25\/president-trump-just-delivered-a-knockout-blow-for-meritocracy-1538925\/\">executive order<\/a> on the matter: \u201cRestoring Equality of Opportunity and Meritocracy.\u201d<\/p>\n<p>The order states, \u201cDisparate-impact liability all but requires individuals and businesses to consider race and engage in racial balancing to avoid potentially crippling legal liability. It not only undermines our national values, but also runs contrary to equal protection under the law, and therefore, violates our Constitution.\u201d<\/p>\n<p>Under the new guidance, a plaintiff wishing to bring a claim must prove a specific hiring practice to be responsible for unequal outcomes and present an alternative that is both effective for employers and results in fewer unequal outcomes.<\/p>\n<p>Seemingly non-discriminatory metrics like aptitude tests and SAT scores would continue to be treated as such, as the opinion detailed, \u201cOnly irrational or arbitrary practices with no plausible job-relatedness can create disparate-impact liability.\u201d<\/p>\n<p>As OLC Assistant Attorney General T.
