Spencer Cox, who\u2019ve been investigating her alleged affair since last month.<\/p>\n<p>Cox, in addition to Utah state Senate President J. Stuart Adams and Utah state House Speaker Mike Schultz suspect Hagen had an inappropriate relationship with an attorney who\u2019d been arguing in favor of a pro-Democrat redistricting map \u2014 one that Hagen later approved.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\"><img decoding=\"async\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/17.0.2\/72x72\/1f6a8.png\" alt=\"\ud83d\udea8\" class=\"wp-smiley\" \/> JUST NOW: Utah Supreme Court Justice Diana Hagen RESIGNS \u2014 the same justice who helped give Democrats +1 Congressional seats out of Utah for the midterms<\/p>\n<p>She\u2019s embroiled in a scandal of reportedly having an AFFAIR with an attorney involved in that redistricting case<\/p>\n<p>GOOD\u2026 <a href=\"https:\/\/t.co\/qGmRsnblEJ\">pic.twitter.com\/qGmRsnblEJ<\/a><\/p>\n<p>\u2014 Eric Daugherty (@EricLDaugh) <a href=\"https:\/\/twitter.com\/EricLDaugh\/status\/2052823195581890612?ref_src=twsrc%5Etfw\">May 8, 2026<\/a><\/p>\n<\/blockquote>\n<p>Their suspicion is based on allegations contained in a complaint that was filed last year by another attorney who claimed Hagen\u2019s ex-husband had told him about her \u201cinappropriate\u201d text messages with attorney David Reymann, according to station <a href=\"https:\/\/www.ksl.com\/article\/51484594\/utah-leaders-to-probe-relationship-between-supreme-court-justice-redistricting-lawyer\" target=\"_blank\" rel=\"noopener\">KSL<\/a>.<\/p>\n<p>The allegations from the ex-husband, Tobin Hagen, are that around the time his marriage was falling apart in 2024, he saw \u201cinappropriate text messages\u201d between her and Reymann.<\/p>\n<p>However, in a declaration to the Judicial Conduct Commission, Hagen vowed that she\u2019d been \u201cfaithful to my ex-husband for more than 30 years.\u201d<\/p>\n<p>\u201cI never engaged in extramarital sex with anyone prior to our separation,\u201d she added.<\/p>\n<p>They were officially divorced in April of last year.<\/p>\n<p>\u201cWhile my ex-husband\u2019s accusations of adultery are false and the intimate details of my failed marriage have nothing to do with my judicial duties or my strict adherence to the Code of Judicial Conduct, I have chosen to self-report these allegations to the Commission to officially refute them under oath,\u201d she continued.<\/p>\n<p>But there\u2019s a problem.<\/p>\n<p>She also admitted in her declaration that both she and her then-husband had attended an event at Reymann\u2019s home on Nov. 3, 2024, which was less than two weeks after she wrote an opinion in a redistricting case that Reymann had been arguing.<\/p>\n<p>Hagen has nevertheless maintained her innocence.<\/p>\n<p>\u201cMy last involvement in the redistricting case was October 2024,\u201d she said last month in a public statement distributed by the Utah Supreme Court. \u201cI voluntarily recused myself from all cases involving Mr. Reymann in May 2025, and my recusal was reflected in the Court\u2019s September 15, 2025, opinion in League of Women Voters.\u201d<\/p>\n<p>Hagen announced her resignation on Friday in a letter to Cox.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Utah News Dispatch: Utah Supreme Court Justice Diana Hagen announces her resignation from the court.<\/p>\n<p>Hagen faced allegations she had a relationship with an attorney involved in a case about redistricting, which led to Utah getting a new congressional map. <a href=\"https:\/\/t.co\/aFQI3Uw8Lf\">pic.twitter.com\/aFQI3Uw8Lf<\/a><\/p>\n<p>\u2014 Politics &amp; Poll Tracker <img decoding=\"async\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/17.0.2\/72x72\/1f4e1.png\" alt=\"\ud83d\udce1\" class=\"wp-smiley\" \/> (@PollTracker2024) <a href=\"https:\/\/twitter.com\/PollTracker2024\/status\/2052811702337519687?ref_src=twsrc%5Etfw\">May 8, 2026<\/a><\/p>\n<\/blockquote>\n<p>\u201cAs a public servant for twenty-six years, I am keenly aware that public service requires sacrifice,\u201d she wrote, according to <a href=\"https:\/\/www.foxnews.com\/politics\/utah-supreme-court-justice-resigns-probe-alleged-relationship-redistricting-attorney\" target=\"_blank\" rel=\"noopener\">Fox News<\/a>. \u201cI have willingly accepted those sacrifices for the privilege of holding a position of public trust, where I could do my part to uphold the rule of law and protect the constitutional rights of every Utahn.\u201d<\/p>\n<p>\u201cI also understand that public officials are rightly held to a higher standard and must accept a greater degree of public scrutiny and diminished privacy. But my family and friends did not choose public life. They do not deserve to have intensely personal details surrounding the painful dissolution of my thirty-year marriage subjected to public scrutiny,\u201d she added.<\/p>\n<p>She\u2019s backed by the\u00a0Utah Supreme Court, which recently issued a statement claiming that the allegations against Hagen had been \u201cinappropriately released to the public,\u201d as reported by <a href=\"https:\/\/utahnewsdispatch.com\/2026\/04\/17\/utah-supreme-court-says-affair-allegations-inappropriately-released\/\" target=\"_blank\" rel=\"noopener\">Utah News Dispatch<\/a>.<\/p>\n<p>\u201cDespite their protected status, records of the Judicial Conduct Commission were inappropriately released to the public,\u201d the court said. \u201d The Judiciary does not have access to those records and did not release them.
