{"id":596672,"date":"2026-05-05T17:09:40","date_gmt":"2026-05-05T17:09:40","guid":{"rendered":"https:\/\/buglecall.org\/?p=596672"},"modified":"2026-05-05T17:09:40","modified_gmt":"2026-05-05T17:09:40","slug":"civil-rights-groups-attempt-to-stop-a-texas-law-that-allows-police-to-arrest-illegal-aliens-2","status":"publish","type":"post","link":"https:\/\/buglecall.org\/?p=596672","title":{"rendered":"Civil rights groups attempt to stop a Texas law that allows police to arrest illegal aliens"},"content":{"rendered":"<div><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"630\" src=\"https:\/\/americanwirenews.com\/wp-content\/uploads\/2026\/05\/gw-illegal-alien-arrest-1200x630.jpg\" class=\"attachment-facebook size-facebook wp-post-image\" alt=\"\" loading=\"lazy\" \/><\/div>\n<p>Several so-called civil rights organizations filed a lawsuit on Monday in an attempt to stop a Texas law that allows police to arrest illegal aliens.<\/p>\n<p>Senate Bill 4, as it\u2019s known, specifically \u201ccreated a state-level crime for entering the country without authorization and created pathways for state authorities to remove such people from the country if convicted,\u201d according to <a href=\"https:\/\/www.texastribune.org\/2026\/05\/04\/texas-senate-bill-4-lawsuit\/\" target=\"_blank\" rel=\"noopener\">The Texas Tribune<\/a>.<\/p>\n<p>It basically makes it so local cops can act with the same level of authority as immigration officials.<\/p>\n<p>The law will finally go into effect next week, thanks to a federal appeals court last month lifting a lower court ruling that had kept the law paused in limbo since 2024.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Breaking News: 5th Circuit Court lifts block on SB4 that lets Texas enforce immigration law.<\/p>\n<p>The Fifth Circuit Court of Appeals lifted an order that blocked enforcement of Texas Senate Bill 4.<\/p>\n<p>SB 4 allows Texas to enforce certain types of immigration crimes such as illegal\u2026 <a href=\"https:\/\/t.co\/m4TBGMeKk3\">pic.twitter.com\/m4TBGMeKk3<\/a><\/p>\n<p>\u2014 hernando arce (@hernandoarce) <a href=\"https:\/\/twitter.com\/hernandoarce\/status\/2048058237543428523?ref_src=twsrc%5Etfw\">April 25, 2026<\/a><\/p>\n<\/blockquote>\n<p>The Texas Civil Rights Project, the ACLU, and the ACLU\u2019s Texas chapter all filed suit Monday, arguing that Senate Bill 4 is unconstitutional because immigration law is a federal matter.<\/p>\n<p>According to the Tribune, the three entities are targeting four key provisions of Senate Bill 4:<\/p>\n<ul>\n<li>\u201cThe creation of a crime for re-entering the country without authorization, even if a person has since obtained legal status.\u201d<\/li>\n<li>\u201cGranting state magistrates authority to order a person\u2019s deportation.\u201d<\/li>\n<li>\u201cThe creation of a crime for failing to comply with a magistrate\u2019s order.\u201d<\/li>\n<li>\u201cRequiring that magistrates continue a prosecution even if a person has a pending immigration case, such as an asylum claim.\u201d<\/li>\n<\/ul>\n<p>\u201cOur fight against SB 4 isn\u2019t over until justice wins,\u201d Kate Gibson Kumar of the Texas Civil Rights Project said in a statement. \u201cSB 4 is not only unconstitutional, but a vile law that uses our Texas resources to harm communities across our state.\u201d<\/p>\n<p>ACLU of Texas Legal Director Adriana Pi\u00f1on referenced similar grievances in a <a href=\"https:\/\/www.aclu.org\/press-releases\/aclu-partners-file-new-lawsuit-challenging-s-b-4-texas-deportation-scheme\" target=\"_blank\" rel=\"noopener\">press release<\/a>.<\/p>\n<p>\u201cS.B. 4 would transform our police and judges into immigration agents \u2014 threatening neighbors who have families here, who have lived here for years, even those who have legal status,\u201d she said in a statement.<\/p>\n<p>\u201cImmigration enforcement is exclusively the federal government\u2019s arena, and no state has ever claimed the power Texas threatens to wield here. We are taking this back to court to defend our Texas communities,\u201d she added.<\/p>\n<p>Cody Wofsy, the deputy director of the ACLU\u2019s Immigrants\u2019 Rights Project, meanwhile, argued that the law is \u201ccruel and illegal.\u201d<\/p>\n<p>\u201cEvery court to have reached the merits of laws like S.B. 4 has found them to be unconstitutional,\u201d he said in a statement while ignoring a higher federal court\u2019s ruling. \u201cS.B. 4 is cruel and illegal, and we will keep fighting it until it is permanently struck down.\u201d<\/p>\n<p>The former Biden administration tried for its part to challenge the law in court two years ago:<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">BREAKING: The Biden administration DOJ just sued Texas over its new border security bill, SB4, which would allow TX authorities to arrest and jail people suspect of crossing illegally into TX, and would seek to give judges authority to deport. Law set to go into effect in March.<\/p>\n<p>\u2014 Bill Melugin (@BillMelugin_) <a href=\"https:\/\/twitter.com\/BillMelugin_\/status\/1742681394919161945?ref_src=twsrc%5Etfw\">January 3, 2024<\/a><\/p>\n<\/blockquote>\n<p>On Dec. 28 of that year, the Biden Department of Justice sent a letter to Texas Gov. Greg Abbott warning that Senate Bill 4 would allegedly violate the U.S. Constitution, according to <a href=\"https:\/\/www.nbcnews.com\/politics\/immigration\/justice-department-threatens-sue-texas-immigration-enforcement-law-rcna131551\" target=\"_blank\" rel=\"noopener\">NBC News<\/a>.<\/p>\n<p>The law \u201ceffectively creates a separate state immigration scheme by imposing criminal penalties for violations of federal provisions on unlawful entry and reentry into the United States \u2026 and by authorizing state judges to order the removal of noncitizens from the United States,\u201d the letter read.<\/p>\n<p>Abbott vowed to fight the suit, with his spokesperson saying in a statement that Texas was \u201cprepared to take this fight all the way to the U.S. Supreme Court to protect Texans and Americans from President Biden\u2019s open border policies.\u201d<\/p>\n<p>Texas Attorney General Ken Paxton later defended the law in court. And as noted earlier, the defense of the law worked.<\/p>\n<p>\u201cMy office has secured yet another major win for Texas by defending SB 4 before the Fifth Circuit,\u201d Paxton said after a federal appeals court restored the law. \u201cTexas\u2019s right to arrest illegals, protect our citizens, and enforce immigration law is fundamental.
