Acting Attorney General Todd Blanche defended the indictment of former FBI Director James Comey as he was questioned about calls for political violence.<\/p>\n

CBS\u2019s chief Washington correspondent, Major Garrett, interviewed Blanche on \u201cCBS Mornings\u201d following the charges against Comey over his \u201c86 47\u201d seashell post on social media last year. Garrett brought up conservative pundit Jack Posobiec, who had posted \u201c8646\u201d during the Biden administration.<\/p>\n

\u201cLet\u2019s do a compare and contrast, Mr. Blanche,\u201d Garrett said. \u201cIn 2022, someone well known in right-wing circles, Jack Posobiec, posted on X, \u20188646.\u2019 He did not take it down. Mr. Comey has done both of those things. The Biden Justice Department never prosecuted him. By the standard of that grand jury, Jack Posobiec should face charges as well. Will the Justice Department pursue that case, because they sound very similar?\u201d<\/p>\n

Blanche fired back with a lesson on how a grand jury works as he reminded that threatening the life of the president is a federal crime.<\/p>\n

\u201cThat\u2019s just completely not true,\u201d he told Garrett.<\/p>\n

\u201cThat\u2019s not how a grand jury does its work. They don\u2019t just look at a single image and then say, \u2018OK, yes, we\u2019ll indict,\u2019 or \u2018OK, no, we won\u2019t indict.\u2019 They do an investigation. This conduct took place in May of last year, May 15. It has been almost a year,\u201d he continued, referring to Comey\u2019s photo of seashells on a beach spelling out \u201c8647.\u201d<\/p>\n

\u201cI assure you, the FBI, the Secret Service, and the U.S. Attorney\u2019s office have not been sitting around doing nothing. They have been investigating. I have no idea whether there was an investigation into the other times that that post has been made and whether that investigation yielded different results,\u201d Blanche said.<\/p>\n

\u201cThis investigation that we undertook resulted in a two-count indictment. So you cannot compare, \u2018Well, what happened last time?\u2019 What happened this time? Every investigation is different. You know that. The American people know that,\u201d the acting AG noted.<\/p>\n

\u201cA lot of factors go into whether someone should or should not be charged. The mere fact there\u2019s a similar photo posted or similar statement made. That\u2019s true every day, there\u2019s comments made about President Trump, threats made against President Trump,\u201d he said. \u201cEvery one of those are not indicted. It depends on the facts of every case.\u201d<\/p>\n

Blanche pushed back at Garrett again when he asked him whether the case against Comey was a \u201cserious\u201d one.<\/p>\n

\u201cIf anybody in this country thinks \u2014 especially given what happened over the past couple of years with respect to President Trump \u2014 that it is okay for anybody to threaten the president of the United States \u2026 and then have the media or others say, well that\u2019s not serious, then we have a bigger problem than I even imagined in this country,\u201d Blanche said.<\/p>\n

\u201cYou cannot threaten the President of the United States. That\u2019s not my decision, that\u2019s Congress\u2019s decision, in a law that they passed,\u201d he added, \u201cand so, yes, of course, this is a serious case.\u201d<\/p>\n
