The profit cap was later removed, and by 2025, OpenAI had transformed into a \u201cpublic benefit corporation.\u201d<\/p>\n<p><strong>Where Things Get Interesting<\/strong><\/p>\n<p>In early 2024, Musk sued OpenAI, accusing the company\u2019s other co-founders \u2014 namely Altman \u2014 of betraying OpenAI\u2019s nonprofit mission.<\/p>\n<p>\u201cHis lawyers argue that Musk poured time, money, and recruiting resources to the AI lab \u2026 on the condition that it would remain a nonprofit \u2018dedicated to creating safe, open-source AGI [artificial general intelligence] for public benefit,\u201d <a href=\"https:\/\/www.npr.org\/2024\/03\/01\/1235159084\/elon-musk-openai-suit-chatgpt-sam-altman-greg-brockman\" target=\"_blank\" rel=\"noopener\">NPR<\/a> reported at the time.<\/p>\n<p>\u201cThe suit \u2026 accuses OpenAI, Altman and the company\u2019s president Greg Brockman of breaking their agreement with Musk by abandoning those founding principles over the years,\u201d the reporting continued.<\/p>\n<p>In a much more recent tweet, Musk accused Altman and Stockman of having \u201cstole a charity.\u201d<\/p>\n<p>\u201cGreg got tens of billions of stock for himself and Scam got dozens of OpenAI side deals with a piece of the action for himself, Y Combinator style,\u201d\u00a0 he wrote. \u201cAfter this lawsuit, Scam will also be awarded tens of billions in stock directly.\u201d<\/p>\n<p>\u201cThe fundamental question is simply this: Do you want to set legal precedent in the United States that it is ok to loot a charity? After this lawsuit, Scam will also be awarded tens of billions in stock\u2026 <a href=\"https:\/\/t.co\/R27ZeG9nNR\">https:\/\/t.co\/R27ZeG9nNR<\/a><\/p>\n<p>\u2014 Elon Musk (@elonmusk) <a href=\"https:\/\/twitter.com\/elonmusk\/status\/2048801964457140540?ref_src=twsrc%5Etfw\">April 27, 2026<\/a><\/p>\n<\/blockquote>\n<p><strong>OpenAI\u2019s Defense<\/strong><\/p>\n<p>The company has tried to defend itself by accusing Musk of having \u201csour grapes\u201d and claiming that he himself had previously agreed to a for-profit structure when funding was low.<\/p>\n<p>\u201c[I]n 2017, Elon not only wanted, but actually created, a for-profit as OpenAI\u2019s proposed new structure,\u201d the company said in a <a href=\"https:\/\/openai.com\/index\/elon-musk-wanted-an-openai-for-profit\/\" target=\"_blank\" rel=\"noopener\">blog post<\/a>. \u201cWhen he didn\u2019t get majority equity and full control, he walked away and told us we would fail.\u201d<\/p>\n<p>\u201cNow that OpenAI is the leading AI research lab and Elon runs a competing AI company, he\u2019s asking the court to stop us from effectively pursuing our mission,\u201d the blog post continued.<\/p>\n<p>The company also took a swing at Musk on the social media platform X, writing, \u201cHis lawsuit remains nothing more than a harassment campaign that\u2019s driven by ego, jealousy and a desire to slow down a competitor.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Today, at the eleventh hour, Elon lodged a court filing pretending to change his tune about attacking the nonprofit OpenAI Foundation.<\/p>\n<p>The truth is that this case has always been about Elon generating more power and more money for what he wants.
