{"id":590432,"date":"2026-04-22T19:50:00","date_gmt":"2026-04-22T19:50:00","guid":{"rendered":"https:\/\/buglecall.org\/?p=590432"},"modified":"2026-04-22T19:50:00","modified_gmt":"2026-04-22T19:50:00","slug":"alligator-alcatraz-can-continue-operating-appeals-court-says-3","status":"publish","type":"post","link":"https:\/\/buglecall.org\/?p=590432","title":{"rendered":"&#8216;Alligator Alcatraz&#8217; Can Continue Operating, Appeals Court Says"},"content":{"rendered":"<p><span class=\"field field--name-title field--type-string field--label-hidden\">&#8216;Alligator Alcatraz&#8217; Can Continue Operating, Appeals Court Says<\/span><\/p>\n<div class=\"clearfix text-formatted field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p><a href=\"https:\/\/www.theepochtimes.com\/us\/alligator-alcatraz-can-continue-operating-appeals-court-says-6015299?utm_source=partner&amp;utm_campaign=ZeroHedge\"><em>Authored by Troy Myers via The Epoch Times,<\/em><\/a><\/p>\n<p><strong>A federal appeals court on Tuesday pulled a judge\u2019s previous order to dismantle the high-profile detention center in the Florida Everglades for illegal immigrants, known as \u201cAlligator Alcatraz.\u201d<\/strong><\/p>\n<p><a data-image-external-href=\"\" data-image-href=\"\/s3\/files\/inline-images\/image%20%2864%29_11.jpg?itok=mUmqgy2t\" data-link-option=\"0\" href=\"https:\/\/cms.zerohedge.com\/s3\/files\/inline-images\/image%20%2864%29_11.jpg?itok=mUmqgy2t\"><img fetchpriority=\"high\" decoding=\"async\" data-entity-type=\"file\" data-entity-uuid=\"1c286fdd-1af0-41b6-a1e7-a79f9be99f48\" data-responsive-image-style=\"inline_images\" height=\"333\" width=\"500\" class=\"inline-images image-style-inline-images\" src=\"https:\/\/assets.zerohedge.com\/s3fs-public\/styles\/inline_image_mobile\/public\/inline-images\/image%20%2864%29_11.jpg?itok=mUmqgy2t\" alt=\"\" \/><\/a><\/p>\n<p>In a 2\u20131 ruling, the U.S. Court of Appeals for the 11th Circuit sided with the Trump administration\u2019s argument that there was minimal federal involvement in the facility\u2019s construction, so a federal environmental review was not warranted.<\/p>\n<p><em><strong>\u201cUsing state employees and state funds, Florida officials, on their own initiative, constructed a detention center at an airport on state property in the Florida Everglades,\u201d <\/strong><\/em>court documents showed.<\/p>\n<p>Two environmental groups, Friends of the Everglades and the Center for Biological Diversity, joined the Miccosukee Tribe, which has villages close to the facility, in challenging construction of Alligator Alcatraz.<\/p>\n<p><strong>The groups accused state and federal officials of rushing to build the facility and failing to conduct an environmental review as required under the National Environmental Policy Act.<\/strong><\/p>\n<p>That federal law, passed in 1970, requires federal agencies to evaluate environmental impacts of proposed major construction.<\/p>\n<p>Construction began last year on the facility, located at the Dade-Collier Training and Transition Airport in the Everglades, to assist with the Trump administration\u2019s immigration enforcement and detainment of illegal aliens.<\/p>\n<p><strong>A lower court in August <a href=\"https:\/\/www.theepochtimes.com\/us\/dismantling-of-alligator-alcatraz-to-continue-after-judge-denies-request-for-delay-5907370\">sided<\/a> with the environmental groups and the Miccosukee Tribe, ordering officials to halt construction and even undo some work that had already been finished. But the higher court\u2019s Tuesday order lifted that.<\/strong><\/p>\n<p>Federal authorities inspected the site for compliance with federal standards, court documents said, but this wasn\u2019t enough to trigger a federally mandated environmental review.<\/p>\n<p><em><strong>\u201cBecause the environmentalists and Tribe failed to prove either a final agency action or federal control, and because the injunction, in part, violates a statutory prohibition of enjoining immigration enforcement, we vacate and remand,\u201d<\/strong><\/em> Chief Judge William Pryor wrote in the federal appeals court ruling.<\/p>\n<p>The 11th circuit has now twice lifted orders to halt construction\u2014Tuesday\u2019s ruling and again back in <a href=\"https:\/\/www.theepochtimes.com\/us\/appeals-court-blocks-judges-order-to-dismantle-alligator-alcatraz-5910567?utm_source=facebook&amp;utm_medium=Social&amp;utm_campaign=epochtimes&amp;fbclid=IwY2xjawNnpKFleHRuA2FlbQIxMABicmlkETFxTVRqc05ybWh5UTE0OVdRAR5CYQvDhA0z5bgIKsDjZMvQeEJ05bsZwtFIG0p0ZTbzTK5v-XPIi0xM0PnuUw_aem_rY7Bp9DruRLIMfz1Jofhfg\">September<\/a>.<\/p>\n<p><em><strong>\u201cVictory secured against activist judge who held me in contempt,\u201d<\/strong><\/em> Florida\u2019s Attorney General James Uthmeier wrote on X in response to the 11th circuit\u2019s September decision.<\/p>\n<p><strong>\u201cA win for Florida and President [Donald] Trump\u2019s agenda!\u201d<\/strong><\/p>\n<p>Friends of the Everglades and the Miccosukee Tribe did not immediately respond to a request for comment.<\/p>\n<p>The Center for Biological Diversity, however, issued a news release Tuesday in response to the latest legal development, calling it a \u201ctemporary\u201d setback.<\/p>\n<p><strong>Wildlife and ecosystems remain imperiled, the group said.<\/strong><\/p>\n<p><em>\u201cThis disappointing decision won\u2019t stop our challenges to the numerous environmental violations that the Trump administration is overseeing there,\u201d Elise Bennett, director and senior attorney at the Center for Biological Diversity, said. \u201cWe\u2019ll keep fighting because the Trump and DeSantis administrations\u2019 obsession with sacrificing our Everglades, endangered panthers and wild waters to their cruel detention center is utterly indefensible.\u201d<\/em><\/p>\n<p>The groups further argue there was enough federal involvement to warrant a federal environmental review.
